
Who is Chapter 7 For?
• Filing Chapter 7 bankruptcy can help people who have financial problems because of job loss, divorce, uninsured medical bills, loss of a family wage earner, or high amounts of credit card debt. If you earn a high income, you may not be eligible to file Chapter 7, but you may still be able to seek relief from your debt under Chapter 13 bankruptcy.
• Chapter 7 is most helpful to people who do not own high-value real estate or many high-value personal possessions, and whose income is too low to pay off their debts.
• California is a community property state. This means that property earned or obtained during a marriage is "community property" which belongs equally to both spouses. Even if only one spouse files for bankruptcy, all of the community property (property belonging to both spouses together) will be taken into the bankruptcy as the "bankruptcy estate." Property in the bankruptcy estate, if not exempt from creditors, is potentially available to repay "community creditors" AND creditors of the filing spouse during bankruptcy. The non-filing spouse’s separate property (such as inherited property, or property owned before marriage by that spouse, and kept in their name alone) is generally not included in the bankruptcy estate.
